By accessing or using the Albertson Call inventory management platform available at alspumps.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
You must be at least 18 years old and authorized by your organization to enter into these Terms. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
You agree not to:
You retain all rights to the data you submit to the Service ("Customer Data"). You grant us a limited license to host, process, and transmit Customer Data solely as necessary to provide the Service. You are responsible for the accuracy, legality, and quality of your Customer Data.
The Service may integrate with third-party services such as QuickBooks Online (Intuit Inc.). When you authorize an integration, you authorize us to exchange data with the third-party service on your behalf solely to deliver the features you enable. Your use of any third-party service is governed by that service's own terms and privacy policies. We are not responsible for the availability, accuracy, or content of third- party services.
We strive to keep the Service available at all times but do not guarantee uninterrupted access. The Service is provided "as is" and "as available" without warranties of any kind, express or implied.
The Service, including its software, design, and trademarks, is owned by Albertson Call and protected by intellectual property laws. These Terms do not grant you any rights in the Service except the limited right to use it as expressly permitted.
If the Service is provided on a paid subscription basis, fees are due in accordance with the plan you select. Fees are non-refundable except as required by law or as expressly stated in writing.
We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason in our reasonable discretion. You may stop using the Service at any time. Upon termination, your right to use the Service ceases immediately.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALBERTSON CALL WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING FROM YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY WILL NOT EXCEED THE AMOUNTS PAID BY YOU TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless Albertson Call, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, or expenses arising out of your use of the Service or violation of these Terms.
These Terms are governed by the laws of the State in which Albertson Call is headquartered, without regard to conflict-of-law principles.
We may update these Terms from time to time. Updates will be posted on this page with a new "Last updated" date. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
